OVERVIEW
Welcome to Burnt Out Candles - where we sell much needed comedic relief in candle form.
The terms "I", "me", "my", “we”, “us”, and “our” refer to Burnt Out Candles. We operate this website and store (the “Services”) to provide you with candles, content, and (hopefully) an enjoyable shopping experience. Our store's backend tech is powered by Shopify, so we can remain focused on doing what we do best -making cool shit.
These Terms of Service (“Terms”) outline your rights and responsibilities when using our Services. As much as I hate legal jargon, it is important here.
By visiting, browsing, or purchasing from our site, you agree to these Terms and our Privacy Policy. If you don’t agree, please don’t use the Services (no hard feelings, we know we're not for everyone).
SECTION 1 – NOVELTY PRODUCTS & MEDICAL DISCLAIMER
Burnt Out Candles are for fun, and not for actual medical use. Yes, our products might look like oversized prescription bottles and come with labels that read like they were written by an unhinged doctor - but they are novelty candles, meant to be funny, empowering, and help make you the best gift-giver ever. Although laughter IS the best medicine, they are not actually medicine. They are not "prescribed" by any real doctors (yet... that would be a cool collab tho), and even though staring at the glowing flickering flame can feel like a tiny therapist in a jar, we are not making that claim.
Nothing sold on this site is intended to treat, diagnose, or cure anything other than a bad mood or a boring apartment. Please don’t eat or otherwise use our candles in a medical context. We hope you’re smarter than that... but legally, we have to say it.
If you have actual health concerns, talk to a licensed healthcare provider. If you just need a warm hug in glowing pill bottle form, we got you. 💙
SECTION 2 – CANDLE SAFETY & USE (PLEASE DON'T BURN DOWN YOUR HOUSE)
We include safety labels on every candle, and we really recommend reading them before use. Here's the gist:
- Burn within sight, and never leave a lit candle unattended.
- Keep away from things that could catch fire: curtains, houseplants, etc. (Emotional baggage, on the other hand, is totally ok to burn)
- Keep out of reach of kids, pets, and that one friend of yours who would definitely maybe try to eat the wax pills.
- Trim your wick to ¼ inch before each use to avoid soot buildup or mega-flame mode. While mega-flame mode sometimes looks cool, please know it's at your own risk.
- Burn on a heat-safe surface and avoid drafts.
- Do not extinguish an active flame with the plastic cap.
- Do not use the plastic cap as a candle base while the candle is lit.
- Discontinue use when ½ inch of wax remains - we know you want every drop, but we care about fire safety. The glass can overheat and shatter. The best way to get the remaining wax out so you can repurpose the bottle is to put it in the freezer overnight. The remaining wax should pop right out cleanly.
SECTION 3 – INTELLECTUAL PROPERTY (DON’T STEAL IT)
All content on this website, including but not limited to product names, descriptions, text, graphics, designs, images, videos, label designs, and overall concept, is the property of Burnt Out Candles, LLC and is protected by applicable copyright, trademark, and intellectual property laws.
No part of this website or its content may be copied, reproduced, republished, uploaded, posted, transmitted, distributed, or otherwise used in any form without prior written permission from Burnt Out Candles, LLC.
That means:
- No copying our product names, label designs, or concepts
- No using our photos, text, or branding without permission
- No remixing, repackaging, or recreating our work and presenting it as your own
You’re welcome to share our content for personal, non-commercial use (like posting your candle on Instagram and tagging us @burntoutrx - we love that!), but anything beyond that requires written permission.
Use of automated systems or software—including bots, scrapers, crawlers, or AI tools—to extract, reproduce, or repurpose content from this website for commercial or competitive use is strictly prohibited.
Basically: show it off, but please - for the love of god and the survival of human artists - don’t rip it off.
SECTION 4 - ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.
To use the Services, including accessing or browsing our online stores or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our stores is correct, current and complete and that you have all rights necessary to provide this information.
You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.
SECTION 5 - OUR PRODUCTS
We have made every effort to provide an accurate representation of our products and services in our online stores. However, please note that colors or product appearance may differ from how they may appear on your screen due to the type of device you use to access the store and your device settings and configuration.
We do not warrant that the appearance or quality of any products or services purchased by you will meet your expectations or be the same as depicted or rendered in our online stores.
All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer to any person, geographic region or jurisdiction, on a case-by-case basis.
SECTION 6 - ORDERS
When you place an order, you are making an offer to purchase. Burnt Out Candles reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until Burnt Out Candles confirms acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as Burnt Out Candles may be unable to accommodate cancellation requests after an order is accepted. In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the e-mail, billing address, and/or phone number provided at the time the order was made.
Your purchases are subject to return or exchange solely in accordance with our Refund Policy.
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.
SECTION 7 - PRICES AND BILLING
Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs or import charges.
Prices posted in our online stores may be different from prices offered in physical stores or in online or other stores operated by third parties. We may offer, from time to time, promotions on the Services that may affect pricing and that are governed by terms and conditions separate from these Terms. If there is a conflict between the terms for a promotion and these Terms, the promotion terms will govern.
You agree to provide current, complete and accurate purchase, payment and account information for all purchases made at our stores.
SECTION 8 - SHIPPING AND DELIVERY
We are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control. Once we transfer products to the carrier, title and risk of loss passes to you.
SECTION 9 - RELATIONSHIP WITH SHOPIFY
Burnt Out Candles is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Burnt Out Candles. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Burnt Out Candles, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Burnt Out Candles.
SECTION 10 - PRIVACY POLICY
All personal information we collect through the Services is subject to our Privacy Policy.
SECTION 11 - FEEDBACK
If you submit, upload, or post feedback, you grant us the right to use it without restriction.
SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS
We reserve the right to correct errors and cancel orders if necessary.
SECTION 13 - PROHIBITED USES
You may not use this site for unlawful purposes, to violate laws, or to infringe on our intellectual property.
